IMPORTANT NOTICE 

 

By the conditions set out below, Phutfumani Couriers and Freight Services and its servants and agents are firstly, not to be liable at all for certain losses and damage and secondly, wherever they are to be liable the amount of liability is strictly limited to the amount stated in Clause 8. Customers are therefore advised to purchase insurance cover to ensure that their interests are protected.  

1. Our Contract with You: 

These terms and conditions are all the terms of the contract between you, the sender of the shipment, and us, Phutfumani Couriers and Freight Services. When you give us your shipment, you accept our terms both for yourself and for anyone else who has an interest in the shipment. Our terms and conditions also protect anyone who may contract to collect, transport or deliver your shipment. No employee of Phutfumani Couriers or anyone else has any authority to change any of our terms and conditions, or make any promise on our behalf. If you give up your goods with instructions which conflict with these terms and conditions, wwill not bound by those instructions. 

 

2. What 'Shipment' means: 

Shipment means all documents or parcels that travel under one waybill. You certify that shipment details are complete and accurate. 

 

3. Shipment we do not Accept:  

Phutfumani Couriers do not accept hazardous, combustible, or explosive materials, precious materials or stone in any form, negotiable securities, negotiable instruments, currency, uncancelled postage or revenue stamps or illegal items and goods, antiques, livestock or any perishable commodity. In the event that any shipper should tender such items to Phutfumani Couriers, the shipper shall indemnify Phutfumani Couriers for all claims damages and expertise, arising in connection therewithPhutfumani Couriers shall further have the right to deal with such terms as it shall see fit, including the right to abandon carriage of the same immediately upon having knowledge that such items have been tendered. 

 

4. Inspection and Charging: 

You agree that we may open and inspect a shipment for any reason at any time. We charge according to the higher of actual or volumetric weight. The shipper ensures that the shipment is packed to protect the enclosed goods to ensure safe transportation with ordinary care in handling; that each package is appropriately labeled and is in good order for carriage. 

 

5. Claims: 

If you wish to claim for lost or damaged shipment: 

- Your claim must be in writing; 

Receipt of your claim must be within 30 days from the date of shipment acceptance; 

- Please submit your claim to Phutfumani Couriers Office or send by email to phutfumani@sptc.co.sz. 

 

6. Extent of our Liability: 

In respect of any shipment, our liability for any loss or damage, however occasioned is limited to the lowest of these two amounts; (Subject to Clause 10): 

- The actual amount any loss or damage suffered by you 

Or 

- The actual value of the shipment. This does not include any commercial value to you or any other 

person. 

7. What we mean by 'Actual Value': 

The lowest of the following amounts determined as at the time and place we accepted the shipment. 

Documents: 

- The cost of repairing or replacing the document; 

-The cost of reconstruction reconstituting the document. 

Parcels: 

- The cost of repairing or replacing the parcel; 

- The actual value of a parcel cannot be more than the original cost to you plus 10 percent. 

 

8. Shipment Insurance:  

We recommend that you take out shipment insurance from: 

- E0-1000 (value of goods) - E50.00 

- Anything above: 5% of value of goods 

 

9. Delayed Shipment: 

We shall make every reasonable effort to deliver your shipment according to our normal schedules but these are not guaranteed and do not form part of this contract. We are not liable for any delays caused by external agents such as Customs. 

 

10. Circumstances beyond our Control:  

We are not liable if shipment is lost, damaged or misdelivered because of circumstances beyond our control. These include:  

- Force majeure; for example earthquake, cyclone, storm, or flood, war, accident, embargo;  

- Any action or omission by anyone outside Phutfumani Couriers; for example the sender or receiver of the shipment, an interested third partyCustoms or other Government officials 

- We are also not liable for electrical or magnetic damage to or erasure of electronic or photographic images or recordings.
